Horizon Recalls 'Humiliation' Over Alleged Unscripted Rape Scene in New Filing Against Kevin Costner,

The stunt performer who filed a sexual-harassment lawsuit against Kevin Costner and the production companies behind Horizon: An American Saga - Chapter 2 is detailing "shock, embarrassment and humiliation" she allegedly experienced on set
In an amended complaint filed in California Wednesday, June 18, attorneys for Devyn LaBella described a situation in which they claimed her personal undergarments were exposed during filming of an alleged unscripted sexual-assault scene

The stunt performer suing Kevin Costner and the production companies behind Horizon: An American Saga - Chapter 2 detailed "shock, embarrassment and humiliation" she says she experienced after she was allegedly made to take part in an unscripted rape scene in the film.
In an amended complaint filed in Los Angeles County Superior Court on Wednesday, June 18, attorneys for stunt performer Devyn LaBella alleged that the scene in question was filmed on May 2, 2023, without the presence of stunt coordinators, intimacy coordinators or other professionals who "would have been present to ensure proper resets and safety such as intimacy protections," per court documents obtained by PEOPLE.
LaBella's amended complaint claims that the actor she filmed the scene with, Roger Ivens, "never separated from Ms. LaBella" between takes for the scene, leaving her unclear as to when the scene was being filmed and when the production was between takes.
"Ms. LaBella was never given the opportunity to prepare for or consent to participate in this scene, much less to object to it," her attorneys alleged. "To the contrary, without a discussion, explanation, rehearsal, choreography session or stunt or intimacy coordinator present, Defendant Costner instructed Ms. LaBella to 'lay down' as Mr. Ivens, who was dirty and covered in sweat, climbed on top of her and then lifted up her skirt while pinning her legs down so she could not move."
Costner's attorney Marty Singer denies LaBella's allegations in a statement, saying, "Ms. LaBella was doing a rehearsal on an Insert Shot for a scripted scene. There was no intimacy or anything sexual in the shot. There was tugging on a dress while she was fully clothed in a dress with long bloomers lying down next to a male actor."

The stunt performer's attorneys also alleged that "her personal undergarments were exposed" during filming for the sequence, which was "especially humiliating to Ms. LaBella as she was menstruating at the time, compounded by the fact that between takes, Mr. Ivens’ hands rested on top of the bundled-up skirt above her vagina."
"Immediately after this scene, Ms. LaBella was left in the wagon alone," the amended complaint alleged, adding further, "She experienced shock, embarrassment and humiliation while attempting to process the situation."
Singer adds in his statement, "Numerous witnesses have contradicted Ms. LaBella's meritless claims. She herself texted her supervisor after she wrapped stating, 'Thank you for these wonderful weeks.' We look forward to the swift end of this specious lawsuit."

LaBella initially filed her complaint against Costner, 70, and the production companies behind his Horizon film series on May 27.
She was initially hired on Horizon as a stunt double for actress Ella Hunt, whom the lawsuit claims walked off the set after allegedly refusing to participate in the scene that LaBella was then asked to "stand in" for.
In a statement shared with PEOPLE in May, Singer denied the claims made against the Oscar-winning director, telling PEOPLE that Costner "always wants to make sure that everyone is comfortable working on his films and takes safety on set very seriously."
Singer also claimed in his May statement to PEOPLE that LaBella is a "serial accuser," and asserted that the claims made in her lawsuit have "absolutely no merit" and are "completely contradicted by her own actions — and the facts."

In response to those claims, LaBella's attorneys said in their amended complaint that she "had never before lodged a claim against any employer" in her career as a stunt performer.
LaBella is suing for damages and that the defendants named in her suit "submit to anti-sexual harassment and anti-sexual violence training," that they be required to use an intimacy coordinator on all future productions and that they issue a public apology.
A rep for Ivens, 44, had no comment about the amended complaint when reached by PEOPLE on Tuesday, June 24.
